Basic Policy on Protection of Personal Information
JAXSON Corporation (hereinafter called “Company”) believes that Company shall be socially responsible for the appropriate handling and protection of personal information of its customers (hereinafter called “Customer”). Company strives to appropriately handle and protect any personal information obtained by Company in accordance with this Basic Policy on Protection of Personal Information (hereinafter called “this Basic Policy”).

Article 1. Definition of Personal Information

The personal information defined in this Basic Policy (hereinafter the “Personal Information”) means any of the following personally identifiable information.

  1. Name, address, date of birth, gender, occupation, phone number and e-mail address, etc.; or
  2. Information which is not personally identifiable itself but which may be easily matched with other information and which becomes personally identifiable by such matching.

Article 2. Acquisition, Purposes of Use or Provision to Third Parties of Personal Information

  1. Company shall acquire Customer’s Personal Information by appropriate means or methods to the extent necessary for the performance of its services.
  2. Any of the following persons may use Customer’s Personal Information.
    1. Company;
    2. Distributor or sales agent of Company’s products; or
    3. Company’s contractor (including any subcontractor).
  3. Company or any company set forth in the item (2) or (3) of the Article 2 (hereinafter called the “PI Acquirer”) may use Customer’s Personal Information only for the following purposes,
    1. Provision of services attractive and valuable to Customer relating to Company’s products;
    2. Delivery of materials or catalogues requested by Customer relating to Company’s products;
    3. Proposal of plans best suited to Customer relating to the products or construction methods, etc. about which Customer consults with Company during the visit booked by Customer to Company’s show room;
    4. Provision of information (such as e-mail newsletters relating to Company’s products) by direct mail or e-mail, etc.;
    5. Delivery of gifts or presents won by Customer in the campaigns, etc.;
    6. Introduction of Customer to Company’s business partners with prior consent of Customer;
    7. Survey of Customer’s usage or satisfaction level relating to Company’s products or services;
    8. Response to Customer’s opinions or requests relating to Company or Company’s products;
    9. Provision of after-sales services or maintenance, etc. of Company’s products to Customer or other communication with Customer; or
    10. Provision of Customer’s Personal Information to the PI Acquirer.
  4. If any person other than Company or the PI Acquirer set forth above needs to use Customer’s Personal Information, or if Company or the PI Acquirer needs to use it for any purpose other than the above purposes of use, Company shall notify Customer in advance of such person and the purposes of use and provide Customer’s Personal Information to such person after obtaining prior consent of Customer, except in the case of the item (2), (4), (5), (6) or (7) of the Article 3.
  5. If Company receives any questions or opinions, etc. from Customer, Company may record the details of communications such as phone call recording. Company shall use such record to confirm the details of such communication or to provide a better response to Customer in the future.

Article 3. Restriction on Provision of Personal Information

Except in any of the following cases, Company shall not provide Customer’s Personal Information to any third parties.

  1. If Company obtains prior consent of Customer;
  2. If Company makes such Personal Information personally unidentifiable;
  3. If Company provides such Personal Information to the PI Acquirer only for the purposes of use set forth in the Article 2;
  4. If Company needs to protect human life, body or properties and has difficulty in obtaining prior consent of Customer;
  5. If Company has a particular need to enhance public health or promote healthy development of children and has difficulty in obtaining prior consent of Customer;
  6. If Company needs to cooperate with any government agency or local public agency who performs its duties under the applicable laws and regulations or with any other person who is entrusted by such agency to perform such duties, and by obtaining a consent of a data subject (e.g. Customer) it may interfere with the performance of such duties; or
  7. If required in accordance with the applicable laws and regulations.

Article 4. Management of Personal Information

  1. Company strives to maintain the security in relation to Company’s website, etc. to prevent any unauthorized access to or leakage, loss or damage, etc. of Customer’s Personal Information. With respect to the Personal Information stored in the automatic processing system, Company makes its best efforts to prevent any unauthorized access to or any loss, falsification or leakage of the Personal Information by taking reasonable and technical measures.
  2. Company strives to cause the PI Acquirer to properly handle and protect Customer’s Personal Information by executing a confidentiality agreement with the PI Acquirer and to prevent its leakage, provision or disclosure from the PI Acquirer to any third parties other than the PI Acquirer or its use for any purpose other than the purposes of use set forth in the Article 2.

Article 5. Disclosure, Correction, Addition, Deletion, Suspension of Use, Erasure or Suspension of Provision to Third Parties of Personal Information

  1. If Customer requests disclosure, correction, addition, deletion, suspension of use, erasure or suspension of provision to third party of Customer’s Personal Information already possessed by Company, Customer may directly contact Company by the following method. Except in the case where Company is required to conduct special procedures pursuant to the applicable laws and regulations, Company shall, in light of preventing leakage of the Personal Information or ensuring accuracy or security, conduct a necessary investigation without delay and disclose, correct, add, delete, suspend the use of, erase or suspend the provision to third parties of Customer’s Personal Information in accordance with the applicable laws and regulations provided that Company has confirmed that such request is made by such Customer. If such request does not meet the requirements of the method of request set forth below, or if Company considers that such request is illegal or unreasonable based on the result of investigation, Company may not respond to such request.
  2. Company shall notify Customer without delay of its approval or rejection of the above disclosure, etc. requested by Customer. If Company rejects the request from Customer, Company strives to explain the reasons for such rejection to Customer.
Method of request for disclosure of Personal Information:

Customer is required to prepare the following three documents and send them to Company’s “Contact” set forth in the Article 12. Customer shall bear all postal charges for such sending.

  1. Request form for disclosure of Personal Information
    Please request from Company a request form for disclosure of Personal Information by e-mail to: contact@example.com
  2. Identification documents to certify that such request is made by Customer or its agent
    Please prepare the following identification documents.
    1. If Customer makes such request:
      A copy of a driver’s license, passport, health insurance certificate or certificate of residence, etc.
    2. If Customer’s agent makes such request:
      A copy of Customer’s and agent’s driver license or certificate of residence, and a power of attorney to attest such agency (if the agent is a lawyer, its license number and a power of attorney to attest such agency) and a certificate of seal registration of Customer.
  3. Return envelope
    Please enclose a return envelope with Customer’s address written and 392 Japanese Yen worth of stamps affixed (82 Yen for postal charge + 310 Yen for simplified registered mail) in sending the request.
Method of request for correction, addition, deletion, suspension of use, erasure or suspension of provision to third parties of the Personal Information:
  1. Customer may contact Company for any correction, addition, deletion or suspension of use, erasure or suspension of provision to third parties of the Personal Information.
  2. Company then sends to Customer by return a request form for correction, addition, deletion, suspension of use, erasure or suspension of provision to third parties of the Personal Information.
  3. Customer returns to Company such request form after filling it out, together with the identification documents to certify that such request is made by Customer or its agent.

    The following identification documents are required.

    1. If Customer makes such request:
      A copy of its driver’s license, passport, health insurance certificate or certificate of residence, etc.
    2. If Customer’s agent makes such request:
      A copy of Customer’s and agent’s driver license or certificate of residence, and a power of attorney to attest such agency (if the agent is a lawyer, its license number and a power of attorney to attest such agency) and a certificate of seal registration of Customer.

Article 6. Provision of Personal Information to the PI Acquirer

  1. Any and all Customer’s Personal Information shall be provided by Company to the PI Acquirer unless otherwise particularly requested by Customer.
  2. Company provides Customer’s Personal Information to the PI Acquirer by paper, transmission of data, delivery of electromagnetic tape or grant of access rights to Company’s servers.
  3. If Customer requests Company to suspend the provision of the Personal Information to the PI Acquirer, Company shall suspend such provision without delay pursuant to the applicable laws and regulations.
  4. Company shall notify Customer of its action or inaction of the suspension set forth in the preceding paragraph without delay. If Company has not acted, Company strives to explain the reasons for such inaction to Customer.

Article 7. Disclaimer

Company shall not be liable for the protection or handling, etc. of Customer’s Personal Information on other websites linked to Company’s website.

Article 8. Compliance with Applicable Laws and Regulations

Company shall comply with any and all laws of Japan relating to the protection of the Personal Information of Customer.

Article 9. Revision of this Basic Policy and Notification

Company may revise this Basic Policy, as necessary. In such case, Company does not give notice to Customer. Therefore, Customer is required to refer to the latest version of the Basic Policy posted on Company’s website from time to time.

Article 10. Use of Cookies

  1. Company’s website has some pages using a technology called “Cookies” in order for Customer to use the website more conveniently when Customer accesses the website again. The “Cookies” is an industry-standard technology to enable the web servers to identify the computer of Customer. The “Cookies” may identity the computer of Customer but may not identify Customer unless Customer enters the Personal Information. Depending on browsers used Customer may disable the Cookies by changing the settings which may result in the unavailability of all or any part of the services on the web pages.
  2. Company may utilize the data obtained by using the Cookies in any of the following cases.
    1. If Company revises or removes its content for more satisfaction of Customer or provides the services customized for an individual Customer; or
    2. If Company analyzes what types of services Customer is interested in or distributes effective advertisements on its website or in any other media provided by third parties.

Article 11. Use of SSL (Secure Socket Layer)

Company protects all of its database by a firewall to prevent any unauthorized access from outside.

Customer may contact Company, as a personal information handling entity, for any questions relating to the details of this Basic Policy at the following point of contact.
